Advice on post-Brexit employment of EU nationals

Since January 2021, the rights of EU nationals are not the same. Many EU nationals continue to have an unrestricted right to work, others may need sponsorship or require proof of a limited right retained from before (such as EU national frontier workers).

Assistance with sponsor licence applications

From December 2020, employers may sponsor medium skilled workers from any country in the world. For this, you need a sponsor licence, and this licence will allow you to sponsor people from the EU if they don’t have have a settled or pre-settled status which protects their pre-Brexit right to work. 

Applications for sponsor licence are not too complicated, but have to be prepared carefully with detailed attention to your internal procedures for immigration compliance. A failed application may trigger a cooling off period of six months, and you may lose the chance to employ the right person at the right time. 

We make all the necessary checks before the Home Office, so that you never worry about an audit or a fine.

We operate the Sponsor Management System for you

We can be appointed as your Key Contact and Level 1 user to manage the Sponsor Management System on your behalf. 

Sponsor Management System has to be regularly updated to reflect any relevant changes to your business or the employee’s terms of contract. Acting as Level 1 users for our clients allows us to notify the Home Office of any relevant matters, request new allocations, assign certificates of sponsorship and keep the SMS up-to-date.

Visa applications for sponsored workers and their family members

We understand that you would wish to make the visa applications for your employees and their family members in the most cost-efficient way and cost will be related to the duration of the visa and the number of people you sponsor.

The sponsored employees are permitted to bring to the UK their immediate family (partner and children under 18). Their immigration route has to be carefully planned to save the time and cost of applications.
